General Terms and Conditions with Customer Information

1) Scope

1.1 These General Terms and Conditions (hereinafter “GTC”) of Goldigen GmbH (hereinafter “Provider”), apply to all contracts for the provision of services that a consumer (hereinafter “Customer”) concludes with the Provider regarding the services presented by the Provider on his website. The inclusion of the Customer’s own conditions is hereby rejected, unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

1.3 The subject of the contract is the provision of services by the Provider according to the product description on the website.

2) Conclusion of Contract / Service Processing

2.1 The product descriptions contained on the Provider’s website do not constitute binding offers by the Provider, but serve to submit a binding offer by the Customer.

2.2 The Customer can submit his offer via the electronic order process integrated into the Provider’s website. By selecting the service, filling out the corresponding form or uploading his documents to the website, and entering his customer data in the electronic order process, the Customer submits a legally binding contract offer for the selected service by clicking the button that completes the order process. The Customer’s offer is automatically accepted by the Provider and confirmed via email. The delivery of the service result to the Customer or the third party selected by him, as well as the invoice, is also automated at this time upon the Customer’s explicit consent. The invoice amount is due for immediate payment.

2.3 For all available payment methods, payment processing is carried out via the payment service provider Stripe Payments Europe, Limited (SPEL), 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. Payment methods available include credit card payment (Visa and Mastercard), PayPal, Apple Pay, and Google Pay. If the Customer selects one of the specified payment methods during the online order process, he simultaneously places a payment processing order with the payment service provider by clicking the button that completes the order process.

2.4 The contract text is stored by the Provider after the conclusion of the contract and sent to the Customer in text form (e.g., email, fax, or letter) after the Customer’s order is submitted. No further access to the contract text is provided by the Provider.

2.5 Before submitting a binding order via the Provider’s electronic order process, the Customer can identify any input errors by carefully reading the information displayed on the screen. A useful technical means for better recognizing input errors may be the browser’s zoom function, which enlarges the display on the screen. All data entered into the respective form is summarized on an overview page at the end of the filling process for review. The Customer can correct his entries during the electronic order process using the usual keyboard and mouse functions until he clicks the button that completes the order process.

2.6 Only the English language is available for the conclusion of the contract.

2.7 Order processing and contact usually take place via email and automated order processing. The Customer must ensure that the email address provided by him for order processing is correct so that emails sent by the Provider can be received at this address. In particular, the Customer must ensure, when using SPAM filters, that all emails sent by the Provider or by third parties commissioned by the Provider with order processing can be delivered.

3) Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Goldigen GmbH, Chodowiecki-straße 14, 10405 Berlin, +491723674871, info@birokrato.com) by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not required.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we are obligated to refund all payments we have received from you, including delivery costs (excluding additional costs arising from your choice of a delivery method other than the least expensive standard delivery we offer), without delay and no later than fourteen days from the day we receive your notice of withdrawal from this contract. For this refund, we will use the same payment method that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

If you requested that the services begin during the withdrawal period, you must pay us an appropriate amount corresponding to the portion of the services already provided up to the point at which you inform us of the exercise of the right of withdrawal in relation to this contract, in comparison to the total scope of the services provided for in the contract.

4) Prices and Payment Conditions

4.1 Unless otherwise stated in the product description of the Provider, the prices quoted are total prices that include statutory VAT. Any additional delivery and shipping costs will be specified separately in the respective product description.

4.2 The payment options are communicated to the Customer on the Provider’s website.

4.3 For payments made using a payment method offered on the website, technical payment processing is handled by Stripe Payments Europe, Limited (SPEL), 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. The terms and conditions and the privacy policy of the payment service provider can be viewed at https://stripe.com/de/privacy. This service provider will withdraw the invoice amount from the Customer’s specified credit card, Apple Pay, or Google Pay account, or facilitate the transfer of the invoice amount from the Customer’s specified PayPal account to the Provider’s PayPal account. The Customer’s PayPal account will be charged immediately after submitting the order on the website. For all payment methods, the Provider remains responsible for general customer inquiries (e.g., regarding the service, complaints, withdrawal declarations).

5) Liability for Damages

5.1 Our liability for contractual breaches and torts is limited to intent and gross negligence. This limitation does not apply to injury to life, body, or health of the Customer, claims due to the breach of cardinal obligations, i.e., obligations arising from the nature of the contract and whose breach endangers the achievement of the contract’s purpose, and compensation for delay damages (§ 286 BGB). In these cases, we are liable for any degree of fault.

5.2 To the extent that liability for damages not based on injury to life, body, or health of the Customer is not excluded for slight negligence, such claims will expire within one year from the time the claim arises or, in the case of claims for damages due to a defect, from the handover of the item.

5.3 If liability for damages against us is excluded or limited, this also applies to personal liability for damages of our employees, workers, staff, representatives, and agents.

6) Applicable Law

All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany, excluding the laws on the international sale of movable goods. This choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

7) Right to Amend

The Provider is entitled to amend these GTC with the Customer’s consent, provided the amendment is reasonable for the Customer considering the Provider’s interests.

8) Alternative Dispute Resolution

8.1 The EU Commission provides an online platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr. This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

8.2 The Provider is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
